Terms of Service

higgscheap gives you access to third-party AI models that generate images and videos from your prompts and reference images. You pay per generation with prepaid credits.

The models are provided by third parties. Which models are available, their settings and their output quality can change at any time. We do not guarantee that a particular model stays available.

• You must be at least 18 years old, or the age of majority where you live, to use the Service.
• You must give a valid email address and keep your login details secret. You are responsible for everything done with your account.
• One person, one account. Accounts may not be shared, sold or transferred.
• We may suspend or close accounts that break these Terms, that we reasonably suspect of fraud or abuse, or that are used to get around a suspension.

• Credits are bought in packs with a one-time payment. There is no subscription and nothing renews automatically.
• Credits never expire while your account exists.
• Each generation costs the number of credits shown before you start it. Prices per model can change; a change never affects a generation you already started.
• Credit purchases are final and non-refundable, except where the law requires a refund. Credits have no cash value and cannot be exchanged, transferred or paid out.
• If a generation fails on our side or at the model provider, its credits are returned to your balance automatically. We may keep the credits of a request that a model provider or our filters blocked under the content policy (section 4). Results you do not like are not refunded.
• Payments are processed by Stripe. Prices are shown in US dollars and may include or exclude taxes as shown at checkout.
• If you dispute or charge back a payment, we may deduct the related credits and suspend the account until the dispute is resolved.

You may only use the Service lawfully. In particular, you must not create, upload or share content that:

• sexualizes minors in any way (zero tolerance; we report it to the authorities);
• shows real people in sexual or intimate situations without their consent, or is otherwise non-consensual intimate imagery;
• impersonates or deceives, such as deepfakes of real people meant to mislead, fraud, scams or election misinformation;
• harasses, threatens, defames or incites violence or hatred against people or groups;
• infringes copyrights, trademarks, personality or privacy rights of others;
• promotes terrorism, self-harm or illegal goods and services, or is otherwise unlawful where you or we are located.

You must not try to get around the safety filters of the models or of the Service, probe, overload or reverse engineer the Service, use bots or scripts outside of features we offer, or resell access to the Service without our written permission.

Model providers may block prompts or results they consider unsafe. Repeated blocked requests can lead to a temporary cooldown or to the suspension of your account. We may remove content and report illegal content to the competent authorities.

You keep all rights you have in your prompts and uploads ("Inputs"). As between you and us, and to the extent the law allows, you own the images and videos generated for you ("Outputs"). We claim no ownership of your Inputs or Outputs.

You give us a limited, worldwide, non-exclusive license to store, process and transmit your Inputs and Outputs, including to the model providers, only as needed to run the Service for you. We do not use your content to train AI models.

AI outputs may not be unique, may resemble the outputs of other users and may not be protected by copyright in every country. You are responsible for checking that your use of an Output is lawful and for any rights of third parties in your Inputs.

You can delete generations from your feed. The image and video files of a deleted generation are removed from our storage within 30 days, except where we must keep them by law.

Generations are processed by third-party AI model providers and infrastructure partners. Their own terms and usage policies may apply to the content you create. Model names are trademarks of their owners; higgscheap is not affiliated with or endorsed by them or by Higgsfield AI.

We work to keep the Service available but do not promise uninterrupted or error-free operation. We may change, pause or discontinue features or models. If we close the Service for good, we will give at least 30 days' notice so you can use your remaining credits; unused credits are not refunded.

The Service and all Outputs are provided "as is" and "as available", without warranties of any kind, to the extent the law allows. AI outputs can be inaccurate, unexpected or unsuitable for your purpose.

To the extent the law allows, we are not liable for indirect or consequential damages, lost profits or lost data, and our total liability is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law.

You will indemnify us against claims of third parties that arise from your Inputs, your use of Outputs or your breach of these Terms, to the extent the law allows.

You can stop using the Service and ask us to delete your account at any time. We may suspend or end your access if you break these Terms. Credits of an account closed for a breach of these Terms are forfeited, to the extent the law allows.

We may update these Terms. We will announce material changes on the website or by email before they take effect. If you keep using the Service after that, the new Terms apply.

These Terms are governed by the laws of the Emirate of Dubai and the applicable federal laws of the United Arab Emirates. The courts of Dubai, United Arab Emirates, have exclusive jurisdiction, unless mandatory law provides otherwise. Mandatory consumer protection rules of your country of residence remain unaffected.
